1. Agreement to Terms
Welcome to the Masters Swim Relay Optimiser (hereafter referred to as "the Application," "the Service," "we," "our," or "us"). These Terms of Service represent a legally binding contract entered into by and between you, whether personally or on behalf of an entity (such as a swimming club, collegiate athletic department, masters swim organization, or coaching staff), and the operators of the Service. By accessing, browsing, registering for, or otherwise using this website, its associated databases, calculation engines, user interfaces, or integration endpoints, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms of Service.
If you do not agree with all of these Terms of Service, you are expressly prohibited from using the Service, and you must discontinue use immediately. We recommend that you print or save a local copy of these terms for your records. These terms govern all access routes, planners, visual features, and operational mechanisms provided under the Masters Swim Relay Optimiser domain name.
We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms of Service, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Service to stay informed of updates. Your continued use of the Application after the date such revised Terms of Service are posted will be deemed to constitute your awareness and acceptance of the changes.
2. Scope of Service
The Masters Swim Relay Optimiser provides swimming coaches, team administrators, and individual competitive swimmers with advanced mathematical algorithms and sorting tools designed to process swimmer rosters, gender categories, age brackets, and stroke seed times. The primary functionality of the Service is to compute and present optimized, valid relay lineups for swimming meets based on constraints specified by the user.
The Service is offered under different usage tiers. The Free Tier provides basic features, smaller roster limits, and ad-supported layouts to offset computation and hosting costs. By utilizing the Free Tier, you agree and consent to the placement of advertising materials by us and our third-party advertising partners, including but not limited to Google AdSense. The Pro Tier is a paid subscription that provides expanded swimmer rosters, ad-free layouts, enhanced export capabilities, and persistent data storage configurations.
We strive to maintain continuous availability of our services. However, we do not guarantee that the Application will operate without interruption, errors, or latency. We reserve the right to modify, suspend, update, or discontinue any part of the Service, including the core optimization logic, visual styling, or pricing structures, at any time without notice or liability to you.
3. User Data & Roster Policies
You retain all rights, ownership, and responsibility for the swimmer lists, roster metrics, seed times, age classifications, and other team data you upload, input, or construct within the Application. We do not claim any ownership rights over your user-uploaded data. It is your responsibility to ensure that the content you input is accurate, lawful, and does not violate the rights of any third party.
To respect your privacy and maximize speed, the Application utilizes client-side storage mechanisms. By default, swimmer rosters, customized preferences, and relay selections are stored exclusively in your web browser's local cache (using the localStorage database key mastersRelayRoster). Because this database resides in your local environment, we hold no liability for data lost due to browser updates, cache clearing, private browsing sessions, or device damage. It is highly recommended that you export backups of your rosters periodically.
You agree not to upload false swimmer parameters, mock times, or malicious scripts that could disrupt the application flow. Furthermore, when utilizing the shareable URL feature (which encodes your roster configurations into a Base64 payload in the query string ?meet=...), you are solely responsible for the distribution of that link. You acknowledge that anyone who accesses your shared link will be able to view and replicate your roster details.
4. Billing & Refund Policy
To unlock full functionality, such as unlimited rosters and ad-free views, you may subscribe to our Pro Tier. Pro Tier subscriptions are charged on an annual recurring basis.
All billing transactions are processed through our secure, PCI-compliant third-party payment gateway, Stripe. We do not store or directly handle your credit card numbers or raw financial credentials. By upgrading to the Pro Tier, you authorize us and our payment processor to charge the applicable subscription fees to your designated payment method.
You can cancel your subscription at any time by logging into your account portal or contacting our support team. Cancellations will take effect at the end of the current billing cycle, and you will continue to have access to the Pro features until your current subscription period expires. Except as required by applicable consumer protection laws in your jurisdiction, all payments are non-refundable, and we do not provide refunds or credits for any partial subscription periods or unused features.
5. Intellectual Property
The underlying source code, visual components, optimization logic, algorithms, databases, graphics, design system configurations, icons, and layout of the website are the exclusive intellectual property of the Masters Swim Relay Optimiser and are protected by national and international copyright, trademark, and trade secret laws. All rights not expressly granted to you are reserved by us.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly for your personal, non-commercial use or for the direct organization of your sports team. You agree that you will not copy, reproduce, distribute, modify, reverse engineer, decompile, or attempt to extract the source code or optimization algorithms of the Application, nor will you build any competing services utilizing similar layout parameters or calculation rules.
6. Limitation of Liability
The service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. We make no guarantees that the calculated relay lineups will comply with the specific rulebooks of all local, national, or international swimming governing bodies (e.g., FINA, USMS, Swim England, etc.), or that the calculated configurations will guarantee team victory or qualification. It is the sole responsibility of the coach or team manager to verify the legal compliance of all generated lineups before final meet submission.
In no event shall the Service operators, their affiliates, partners, or licensors be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage. We are not liable for any disqualifications, meet scheduling conflicts, browser storage corruptions, or financial losses associated with service downtime.
7. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the jurisdiction in which the principal operators of the Service reside, without giving effect to any principles of conflicts of law.
Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Application shall be instituted exclusively in the federal or state courts located in the primary jurisdiction of the operators. You consent to the personal jurisdiction of such courts and waive any objections to the exercise of jurisdiction over you by such courts or to venue in such courts.
